1. Terms & Condition of Use 

1.1 You are cordially welcome to Picky Bangladesh E-Commerce Limited ("Picky"). Picky grants your access to the picky.com.bd website, mobile application/app, or any other media ("Website"), subject to the terms and conditions set forth on this page ("Terms"). You, as a registered or guest user who meets the eligibility conditions set out herein ("User"), agree to be bound by the terms by using the Website. Please read them carefully since by continuing to use the Website, you agree to be bound by these terms. You must not subscribe to or use the Website or our services if you do not agree to be bound by the terms.

1.2 You accept and agree to be bound by Picky Policies (including but not limited to the Privacy Policy found at (https://Picky.com.bd/t/PrivacyInfo) as revised from time to time by implicitly or expressly accepting these Terms.

1.3 The end user/customer using the Website, its contents, and using the Services supplied through the Website is referred to as "you" in these Terms. The terms "Website," "Picky," "Picky.com.bd," "we," "us," tronic record in terms of Information & Communication Technology Act, 2011 (তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০১১) and rules there under as applicable and as amended from time to time.

1.4 Need to be remembered this document does not require any physical or digital signatures and forms a valid and binding agreement between the Website and the User. 

1.5 The Website is owned and run by Picky Bangladesh E-Commerce Limited, a Bangladeshi corporation with its registered office at 89 West Brahmondi, Narsingdi Sadar, Narsingdi, Bangladesh. In inclusion of the online portal, any references to the Website in these Terms shall be deemed to refer to the aforementioned organization.

1.6 This Website may also contain links to other websites that are not managed by Picky. Picky has no control over the linked sites and assumes no responsibility for them or any loss or damage that may occur as a result of your use of them. The terms of use and service found within each linked site will govern your use of that site. 

1.7 At any time, we retain the right to modify these Terms. When the updates are uploaded on the website, they become effective. You accept the Terms as updated if you continue to use the Website after we post any such changes.

1.8 These Terms will continue to apply until terminated by either you or Picky in accordance with the terms set out below:

1.10 Regardless of the above, the provisions set forth in these Terms that are intended to survive termination by their very nature will survive the termination/expiration of this agreement.

2.  Eligibility 

2.1 Use of the Website is available only to such persons who can legally contract under the Contract Act, 1872. 

2.2 If you are under the age of 18, you must not register as a user of picky.com.bd and you must not transact on or use the Website. If you are a minor and wish to use or transact on the website, your legal guardian or parents may do so on your behalf. If it is brought to Picky's attention or it is discovered that you are under the age of 18, Picky retains the right to terminate your membership and/or refuse to provide you with access to the website.

2.3 Accepting the Terms or using or transacting on the Website constitutes an irrevocable declaration and undertaking by the User that he or she is of legal age, i.e. 18 years or older, and capable of entering into a binding contract, and such usage shall be deemed to form a contract between the Website and such User to the extent permissible under applicable laws.

2.4 The usage of the services offered through the Website is only available if the address of the user to which the product(s) is/are to be delivered is within Bangladesh; Picky is serving within 30 minutes Express Delivery Service to Narsingdi, Bangladesh. For the Regular Delivery, Picky is currently delivering within 3 to 5 working days timeframe.  Subject to the above, if the user specifies a convenient time and Picky will send the products during that time. 

3.  Communication 

3.1 You consent to receive messages from us while you use picky.com.bd or contact us by phone or email. You give us permission to communicate with you via e-mail, SMS, phone call, posting notices on the website, or any other means. You consent to receive communications (including transactional, promotional, and/or commercial messages) from us regarding your use of the website and/or your order placed in the website for contractual purposes. Furthermore, any disclosures made on the site or conveyed to you through email satisfy the legal requirement of written communication.

4. Your Account and Responsibilities 

4.1 Anyone can use the Website either by registering for an account or by visiting it as a guest. A guest user, on the other hand, may not have access to all areas of the Website, including certain benefits/promotional offers that are restricted solely for registered users and may vary from time to time at the Website's sole discretion.

4.2 If you want to create an account on the Website, you must do so by registering with a valid Bangladeshi mobile number and/or your Facebook account or your email address, or by filling out the information requested on the Website registration form. After that, you'll receive a password or one-time PIN that you may use to log in to the website and place orders.

4.3 If you use the website, you are responsible for keeping your username and password secure, and you are responsible for any activities that occur under your username. You must also restrict access to your computer or mobile phone to prevent unauthorized access to your account. If you have reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unlawful manner, you should notify us immediately. You agree that we have the right to suspend or terminate your membership on the website if you provide any information that is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, or not in accordance with these Terms of Use. 

4.4 The Website may be inaccessible for such purposes as it may, at its sole discretions deem necessary, including but not limited to regular maintenance. However, under no circumstances will Picky be held liable for any losses or claims arising out of such inaccessibility to the Users and the Users expressly waive any claims against Picky in this regard.

4.5  Picky as a platform does not allow or encourage numerous accounts held by the same user, even if they have different mobile numbers, and reserves the right to restrict, deactivate, or disable any account that may be abused.

5.  Charges 

5.1 Users do not have to pay to join the website/app. Picky does not charge a fee to browse the website/app or make purchases. Picky maintains the right to modify its fee structure at any time. Picky, in particular, may introduce new services and modify some or all of the existing services offered on the website at its sole discretion. In this scenario, Picky reserves the right to charge fees for new services or amend/introduce prices for existing services, as appropriate. Changes to the charge policy will be publicized on the website, and they will take effect immediately after they are published.

6.   Copyright 

6.1 Picky Bangladesh E-commerce Limited, its subsidiaries, affiliates, and/or third-party licensors own the material (including the content and any other content, software, or services) found on Picky.com.bd. Without express permission from Picky Bangladesh E-commerce Limited, no material on this site may be copied, reproduced, reprinted, installed, posted, transmitted, stored, or distributed is strictly prohibited.

6.2 You may not use any "deep-link," "page-scrape," "robot," "spider," or other automatic devices, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the website or any content, or to reproduce or circumvent the navigational structure or presentation of the website or any content, or to obtain or attempt to obtain any materials, documents, or information through any means not purposefully made available, or to obtain or attempt to obtain any We reserve the right to prohibit such behaviour.

7.  Cookies 

7.1 This site makes use of cookies, which means you must have cookies enabled on your computer for all of the site's features to work properly. When you visit certain Web sites, a cookie is a little data file that is written to your hard drive. Cookie files store information such as a random numeric user ID that a website allocates to a visitor in order to track the sites they visit. Cookies are unable to read data from your hard drive or read cookie files established by other websites. Cookies cannot be used to determine a user's identity on their own.

8.  Promotional Activity 

8.1 To showcase the company's services to the best of our knowledge and belief, Picky uses numerous advertisements and ads that are accurate and neither deceptive nor unfair. Before using the service, each user is required to read the necessary information on the Website, and it will be presumed that each user is aware of the information presented on the Website. Images of products on the Website are for illustration purposes only, and the actual product may differ from the image displayed. To the fullest extent permissible by law, the Website disclaims any and all liabilities arising out of any differences to this purpose.

8.2 Any short-term or long-term promotional activity or offer(s) under any specific account on picky.com.bd are by default valid for a single order during the offered time period. Any repeated, suspicious, or abusive behaviour during any offer or promotion may result in an order being cancelled, and Picky maintains the right to do so in order to defend the rights and benefits of other users. Accounts that abuse any offer on the platform in any way may be terminated in order to maintain the platform's hygiene element. Picky automated abuse detection system can be used at any moment and without any notice.

8.3 Discount codes provided to any/all segments of customers via various marketing channels may be disabled or extended by the authorities at any time and without notice. To prevent any kind of abuse or suspicious usage, the modality can also be adjusted to accommodate price changes or fluctuations, as well as the intensity of use of the same by the user base.

9.  The Contract 

9.1 Your order is an offer to us to buy the product(s) in your order. When you place an order to purchase a product from us, you will receive an e-mail and/or SMS to your mobile phone number confirming receipt of your order and/or containing the details of your order (the "Order Confirmation E-mail and/or SMS"). The Order Confirmation E-mail and/or SMS is an acknowledgment that we have received your order, but does not confirm acceptance of your offer to buy the product(s) ordered; that when we send the Order Confirmation E-mail and/or SMS a contract called an “agreement to sell” is concluded in accordance with Section 4(3) of the Sale of Goods Act, 1930 i.e. the transfer of the property in the goods is to take place at a future time when the product(s) is/are delivered to your designated address. We only accept your offer, and the above “agreement to sell” becomes a contract of sale for the product(s) ordered by you in accordance with Section 4(4) of the Sale of Goods Act, 1930, when the product(s) is/are delivered to your designated address and at that time the property in the goods is transferred from us to you. 

9.2 You can cancel your order for a product at no cost any time before the goods are delivered to you. 

9.3 Please keep in mind you can order a single or a multiple items in a order which are need in our daily lives though Picky is a reliable online multi-vendor market place.

10.  Product Descriptions 

10.1 Picky makes every effort to be as precise as possible. Picky does not create or manufacture any of its own products. As a result, Picky makes no representations or warranties about the accuracy, completeness, reliability, correctness, or error-free nature of any Picky product description or other information. If a product sold by Picky does not meet your expectations, your only option is to return it in unused condition and immediately notify to us.

11.  Pricing 

11.1 Unless otherwise stated, the list price or suggested price displayed on Picky represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a similarly featured item offered elsewhere. The list price, also known as the suggested price, is a comparative pricing estimate that may or may not reflect the current market price in every place on any given day.

11.2 Despite our best efforts, there is a chance that some of the items in our catalogue are incorrectly priced. If the MRP of an item sold by Picky is greater than our advertised price, we will contact you for instructions before delivery or cancel your order and alert you. And, if the product's advertised price is lower than Picky, we'll either refund the difference or replace the item, depending on your desire, once we've received confirmation.

12. Return Policy (in case of following situations)

12.1 A user may return any product during the time of delivery, or within 7 days if anything happened as mentioned earlier. Picky will monitor continuously and closely and will take necessary steps to prevent this.

12.2 A user may return any unopened or defective items within 7 days of receiving the item. But following products may not be eligible for return or replacement:

13.1 Customer satisfaction is our first preference. So, Picky makes every effort to meet the needs of its customers. However, if we fail to meet our commitment or supply the service for any reason, we will tell you through phone, text, or email within 24 hours. If Picky fails to perform a service and a refund is required, it will be processed within 7 days of our acknowledgment. Remember: Picky prefers to replace the goods instead of refunding due to lengthy process of refunding process.

13.2 Refund requests will be processed under mentioned situation:

The refund amount will be paid to the customer's Picky Balance in all three instances. And the remaining balance may only be utilized at Picky. Within 7 days of receiving a customer's request, Picky will transfer the refund amount to the user's original payment source. Customers who paid with bKash, Nagad, card, or other electronic methods are eligible for a refund. Picky Credits are the only way to get a refund for orders that were purchased in cash.

14.  Supply Policy: 

14.1 Picky tries to maintain quality control but does not give quality assurance because it does not design or manufacture any products. We believe that the manufacturer, seller, or supplier is fully capable of ensuring the quality of the products.

14.2 If a user discovers a product that is harmful for their health, life, or security after receiving their order, we shall accept full responsibility and accept the return of that product. If the user is threatened after 12 hours of receiving the delivery, we will consider it a flaw in the manufacturers or suppliers quality assurance.

14.3 All products displayed on the website are subject to change and are subject to availability. 

15.  Modifications 

15.1 Picky reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on picky.com.bd. You are responsible for reviewing of such modifications. Your continued access or use of picky.com.bd shall be deemed your acceptance of the modified terms and conditions. 

16. Picky Software Terms 

16.1 Use of the Picky Software/Application/App: You may use Picky Software/ Application/ App solely for purposes of enabling you to use and enjoy the services as provided by Picky and as permitted by these Terms. You may not incorporate any portion of the Picky Software / Application/ App into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the Picky Software / Application/ App or otherwise assign any rights to the Picky Software / Application/ App in whole or in part. You may not use the Picky Software / Application/ App for any illegal purpose. We may cease providing any Picky Software / Application/ App and we may terminate your right to use any Picky Software / Application/ App at any time. Your rights to use the Picky Software / Application/ App will automatically terminate without notice from us if you fail to comply with any of these Terms. All software used in any Picky Service is the property of Picky and/or its affiliates or its software suppliers and protected by laws of Bangladesh including but not limited to any other applicable copyright laws. 

16.2 When you use the Picky Software / Application/ App, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. These third-party services may have their own policies, terms of service, and fees that apply to your use of them.

16.3 No Reverse Engineering: You may not copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with the Picky Software / Application/ App, in whole or in part, or create any derivative works from or of the Picky Software / Application/ App, and you will not encourage, assist, or authorize anyone else to do so.

16.4 Updates: We may offer automatic or manual updates to the Picky Software / Application/ App at any time and without notification to you in order to maintain it up-to-date.

১। ব্যবহারের শর্তাবলী

১.১। আপনাকে পিকি বাংলাদেশ ই-কমার্স লিমিটেডে ("পিকিতে") আন্তরিকভাবে স্বাগতম। Picky আপনাকে picky.com.bd ওয়েবসাইট, মোবাইল অ্যাপ্লিকেশন/অ্যাপ, বা অন্য কোনো মিডিয়াতে ("ওয়েবসাইট") কিছু শর্ত সাপেক্ষে আপনাকে ব্যবহারের অনুমোদন দেয়। এক্ষেত্রে পিকির শর্তাবলী মেনে আপনাকে একজন নিবন্ধিত বা অতিথি হিসেবে পিকিতে যুক্ত হতে হবে। অন্যথায় আপনি আমাদের ওয়েবসাইট এবং প্রযুক্তিগত অন্যান্য সুবিধা ভোগ করতে পারবেন না।

১.২। আপনি যখন পিকির শর্তাবলী মেনে আমাদের সাথে চুক্তিতে আবদ্ধ হবেন আপনাকে অবশ্যই পিকির সকল নিয়মকানুন মেনে চলতে হবে (যদিও নিয়ম-কানুন ও শর্তাবলী সময়ের সাথে মিল রেখে পরিবর্তন, পরিবর্ধন, সংযোজন ও বিয়োজন হতে পারে)।

১.৩ ওয়েবসাইট ব্যবহারকারী/গ্রাহক, এর বিষয়বস্তু, এবং ওয়েবসাইটের মাধ্যমে সরবরাহ করা পরিসেবাগুলির ব্যবহার করে এই শর্তাবলীতে "আপনি" হিসাবে উল্লেখ করা হয়েছে৷ শর্তাবলী "ওয়েবসাইট," "Picky," "Picky.com.bd," "আমরা," "আমাদের," তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০১১ (তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০১১) এর আওতাধীন করা হয়েছে।

১.৪) মনে রাখতে হবে ওয়েবসাইট এবং এর ব্যবহারকারীর মধ্যে সম্পাদিত বৈধ এবং বাধ্যতামূলক চুক্তিতে শারীরিক বা ডিজিটাল কোন স্বাক্ষরের প্রয়োজন নেই।

১.৫) ওয়েবসাইটটি বাংলাদেশী প্রতিষ্ঠান "পিকি বাংলাদেশ ই-কমার্স লিমিটেড" এর মালিকানাধীন এবং পরিচালিত। প্রতিষ্ঠানটির নিবন্ধিত ঠিকানা ৮৯, পশ্চিম ব্রাহ্মন্দী, নরসিংদী সদর, নরসিংদী, বাংলাদেশ।

অনলাইন পোর্টালের অন্তর্ভুক্তিতে, এই শর্তাবলীতে ওয়েবসাইটের যে কোনো রেফারেন্স, উল্লিখিত সংস্থার বলে গণ্য করা হবে।

১.৬ এই ওয়েবসাইটটিতে অন্যান্য ওয়েবসাইটগুলির সম্পৃক্ততা থাকতে পারে যেগুলি পিকি দ্বারা পরিচালিত হয় না এবং ঐ সাইটগুলির উপর কোনও নিয়ন্ত্রণ ও দায়বদ্ধতা আমাদের নেই। মনে রাখতে হবে প্রতিটি লিঙ্ক করা সাইটের মধ্যে পাওয়া ব্যবহারের শর্তাবলী এবং পরিসেবা আপনার সেই সাইটের ব্যবহার নিয়ন্ত্রণ করবে।

১.৭। যে কোনো সময়ে এই শর্তাবলী সংশোধন করার অধিকার পিকির রয়েছে। যখন আপডেটগুলি ওয়েবসাইটে আপলোড করা হয়, তখন তারা কার্যকর হয়। আমরা এই ধরনের কোনো পরিবর্তন পোস্ট করার পর আপনি যদি ওয়েবসাইট ব্যবহার করা চালিয়ে যান তাহলে আপনি শর্তাবলীকে আপডেট হিসাবে স্বীকার করেন বলে মনে করা হবে।

১.৯। আপনি নিম্নলিখিত উপায়ে পিকির সাথে আপনার চুক্তির অবসান ঘটাতে পারেন।

১.১০। যাই হোক স্বভাবগত কারণেই এই সকল যুক্তিগুলো সব সময় বলবৎ থাকবে।

২। উপযুক্ততা:

২.১। যারা ১৮৭২ এক্ট এর অধীনে চুক্তি সম্পাদন করেছে তারাই কেবলমাত্র ওয়েবসাইট ব্যবহারের জন্য বৈধ।

২.২। আপনার বয়স ১৮ বছরের কম হলে, আপনি picky.com.bd-এর ব্যবহারকারী হিসাবে নিবন্ধন করতে পারবেন না এবং ওয়েবসাইটটিতে কোন লেনদেনে অংশগ্রহণ করতে পারবেন না।আপনি যদি নাবালক হন এবং ওয়েবসাইটটি ব্যবহার বা লেনদেন করতে চান, তাহলে আপনার আইনি অভিভাবক বা পিতামাতা আপনার পক্ষে তা করতে পারেন। যদি এটি পিকির নজরে আসে বা উদঘঠিত হয় যে আপনি ১৮ বছরের কম বয়সী, তাহলে আপনার সদস্য পদ বাতিল এবং ওয়েবসাইট ব্যবহার নিষিদ্ধ করা হতে পারে।

২.৩ ওয়েবসাইট ব্যবহারের ক্ষেত্রে এটি একটি অপরিবর্তনীয় ঘোষণা যে ১৮ বছর বা তার বেশি বয়সী লোকেরাই কেবলমাত্র এটি ব্যবহারের জন্য অনুমোদিত। ওয়েবসাইট এবং এর ব্যবহারকারীর মধ্যে একটি আইনগত চুক্তি নামা থাকতে হবে।

২.৪ শুধুমাত্র বাংলাদেশের মধ্যেই ওয়েবসাইটের মাধ্যমে প্রদত্ত পরিসেবা গুলো দেওয়া সম্ভব। বর্তমানে নরসিংদীতে ৩০ মিনিটের মধ্যে এক্সপ্রেস ডেলিভারি সার্ভিস এবং বাংলাদেশের অন্যান্য সকল জেলায় ৩ থেকে ৫ কর্ম দিবসের মধ্যে পণ্য সরবরাহ করা হচ্ছে। শর্ত থাকে যে গ্রাহক তার ফরমায়েসে উল্লেখিত সময়ে উপস্থিত থেকে পণ্যটি ডেলিভারি ম্যান এর থেকে গ্রহণ করতে হবে।

৩। যোগাযোগ

৩.১। আপনি picky.com.bd ব্যবহার করার সময় বা ফোন বা ইমেলের মাধ্যমে আমাদের সাথে যোগাযোগ করার সময় আপনার অনুমোদনক্রমে আমাদের থেকে নিয়মিত বার্তা পেতে থাকবেন। আপনি আমাদেরকে ই-মেইল, এসএমএস, ফোন কল, ওয়েবসাইটে নোটিশ পোস্ট করার মাধ্যমে বা অন্য কোনো মাধ্যমে আপনার সাথে যোগাযোগ করার অনুমতি প্রদান করায় আপনি আমাদের কাছ থেকে যোগাযোগ (লেনদেনমূলক, প্রচারমূলক, এবং/অথবা বাণিজ্যিক বার্তা সহ) ওয়েবসাইটের আপনার ব্যবহার এবং/অথবা চুক্তিভিত্তিক উদ্দেশ্যে ওয়েবসাইটে দেওয়া আপনার অর্ডার সম্পর্কে আমরা আপনাকে অবহিত করব। তদ্ব্যতীত, সাইটে করা যেকোনো প্রকাশ বা ইমেলের মাধ্যমে আপনাকে জানানো লিখিত যোগাযোগের জন্য আইনগত সিদ্ধতা রয়েছে।

৪.৩। আপনি যদি ওয়েবসাইটটি ব্যবহার করেন তবে আপনার ব্যবহারকারীর নাম এবং পাসওয়ার্ড সুরক্ষিত রাখার জন্য আপনি দায়ী এবং আপনার ব্যবহারকারীর নামের অধীনে ঘটে যাওয়া যেকোনো কার্যকলাপের জন্য আপনি দায়ী৷ আপনার অ্যাকাউন্টে অননুমোদিত অ্যাক্সেস রোধ করতে আপনাকে অবশ্যই আপনার কম্পিউটার বা মোবাইল ফোনে অ্যাক্সেস সীমাবদ্ধ করতে হবে। আপনার যদি বিশ্বাস করার কারণ থাকে যে আপনার পাসওয়ার্ড অন্য কেউ জেনে গেছে, বা যদি পাসওয়ার্ডটি বেআইনি উপায়ে ব্যবহার করা হয় বা হওয়ার সম্ভাবনা থাকে, তাহলে আপনার অবিলম্বে আমাদের জানানো উচিৎ। আপনি যদি আমাদের অসত্য, সঠিক নয় বর্তমান সময়ের জন্য এবং অসম্পূর্ণ কোন তথ্য প্রদান করেন এবং সন্দেহবশত সেই তথ্যগুলো সঠিক নয প্রমাণিত হয় তাহলে আমরা আপনার সদস্যপথ বাতিল করব ওয়েবসাইট ব্যবহারের শর্তাবলী অনুসরণ না করার জন্য।

৪.৪। ওয়েবসাইটটি তার নিজস্ব বিবেচনার ভিত্তিতে প্রয়োজনীয় বলে মনে করতে পারে এমন উদ্দেশ্যে অ্যাক্সেসযোগ্য হতে পারে। তবে নিয়মিত রক্ষণাবেক্ষণ সহ কিছূ সীমাবদ্ধ থাকতে পারে যখন ওয়েবসাইট পরিদর্শন সম্ভব হবে না। যাইহোক, ওয়েবসাইটে পরিদর্শনকালে কেউ কোন তথ্য হারিয়ে ফেললে বা কোন ক্ষতির সম্মুখীন হলে তার জন্য পিকি কর্তৃপক্ষ দায়ী থাকবে না।

৪.৫। একজন ব্যবহারকারী ভিন্ন ভিন্ন মোবাইল নাম্বার দিয়ে একাধিক অ্যাকাউন্ট খোলা পিকি অনুমোদন করে না। এমনটি হলে পিকি তার অ্যাকাউন্ট সীমাবদ্ধ বা নিষ্ক্রিয় করে দিতে পারে।

৫। চার্জ

৫.১। ব্যবহারকারীদের ওয়েবসাইট/অ্যাপে যোগদানের জন্য অর্থ প্রদান করতে হবে না। ওয়েবসাইট/অ্যাপ ব্রাউজ করতে বা কেনাকাটা করতে পিকি কোনো ফি নেয় না। পিকি যেকোনো সময় তার ফি কাঠামো পরিবর্তন করার অধিকার বজায় রাখে। পিকি, বিশেষ করে, নতুন পরিসেবাগুলি প্রবর্তন করতে পারে এবং নিজের বিবেচনার ভিত্তিতে ওয়েবসাইটে দেওয়া কিছু বা সমস্ত বিদ্যমান পরিসেবাগুলিকে সংশোধন করতে পারে৷ সেক্ষেত্রে পিকি নতুন পরিসেবার জন্য ফি নেওয়ার বা বিদ্যমান পরিসেবাগুলির জন্য মূল্য সংশোধন/পরিবর্তন করার অধিকার সংরক্ষণ করে। চার্জ নীতিতে পরিবর্তনগুলি ওয়েবসাইটে প্রকাশ করা হবে, এবং সেগুলি প্রকাশিত হওয়ার সাথে সাথেই কার্যকর হবে৷

৬। কপিরাইট

৬.১। পিকি বাংলাদেশ ই-কমার্স লিমিটেড, এর অধীনস্থ সংস্থা, সহযোগী এবং/অথবা তৃতীয় পক্ষের লাইসেন্সদাতারা Picky.com.bd-এ পাওয়া উপাদানের মালিক (বিষয়বস্তু এবং অন্য যেকোন বিষয়বস্তু, সফ্টওয়্যার বা পরিসেবা সহ)। পিকি বাংলাদেশ ই-কমার্স লিমিটেড থেকে প্রকাশ্য অনুমতি ব্যতীত, এই সাইটের কোন উপাদান কপি, পুনরুৎপাদন, পুনঃমুদ্রণ, ইনস্টল, পোস্ট, প্রেরণ, সংরক্ষণ বা বিতরণ করা কঠোরভাবে নিষিদ্ধ।

৬.২। আপনি কোনো "ডিপ-লিঙ্ক," "পৃষ্ঠা-স্ক্র্যাপ," "রোবট," "স্পাইডার" বা অন্যান্য স্বয়ংক্রিয় ডিভাইস, প্রোগ্রাম, অ্যালগরিদম, বা পদ্ধতি, বা অনুরূপ বা সমতুল্য ম্যানুয়াল প্রক্রিয়া ব্যবহার করতে পারবেন না, অ্যাক্সেস, অর্জন করতে , ওয়েবসাইট বা কোন বিষয়বস্তুর কোন অংশ অনুলিপি করা বা পর্যবেক্ষণ করা, অথবা ওয়েবসাইট বা কোন বিষয়বস্তুর ন্যাভিগেশনাল স্ট্রাকচার বা উপস্থাপনাকে পুনরুৎপাদন করা বা বাধা দেওয়া, অথবা উদ্দেশ্যমূলকভাবে নয় এমন কোন উপায়ে কোন উপকরণ, নথি বা তথ্য নেয়া বা নেয়ার চেষ্টাকে আমরা নিরুৎসাহিত ও নিষিদ্ধ করি।

৭। কুকিজ

৭.১। এই সাইটটি কুকিজ ব্যবহার করে, যার মানে সাইটের সমস্ত বৈশিষ্ট্য সঠিকভাবে কাজ করার জন্য আপনার কম্পিউটারে কুকিজ সক্রিয় থাকতে হবে৷ আপনি যখন কিছু নির্দিষ্ট ওয়েব সাইট পরিদর্শন করেন, তখন কুকি হল একটি ছোট ডেটা ফাইল যা আপনার হার্ড ড্রাইভে লেখা হয়। কুকি ফাইলগুলি তথ্য সঞ্চয় করে যেমন একটি এলোমেলো সাংখ্যিক ব্যবহারকারী আইডি যা একটি ওয়েবসাইট দর্শকদের জন্য বরাদ্দ করে তারা যে সাইটগুলি পরিদর্শন করে তা ট্র্যাক করার জন্য৷ কুকিগুলি আপনার হার্ড ড্রাইভ থেকে ডেটা পড়তে বা অন্যান্য ওয়েবসাইট দ্বারা প্রতিষ্ঠিত কুকি ফাইলগুলি পড়তে অক্ষম। ব্যবহারকারীর পরিচয় নির্ধারণ করতে কুকি ব্যবহার করা যাবে না।

৮। প্রচারমূলক কার্যকলাপ

৮.১। আমাদের জ্ঞান এবং বিশ্বাসের সর্বোত্তমভাবে কোম্পানির পরিসেবাগুলি প্রদর্শন করার জন্য, পিকি ভিন্ন ভিন্ন সময়ে নানা রকম বিজ্ঞাপন ব্যবহার করে যা সঠিক এবং মোটেই প্রতারণামূলক নয়। পরিসেবাটি ব্যবহার করার আগে, প্রতিটি ব্যবহারকারীকে ওয়েবসাইটে প্রয়োজনীয় তথ্য পড়তে হবে এবং এটি বুঝতে হবে যে প্রতিটি ব্যবহারকারী ওয়েবসাইটে উপস্থাপিত তথ্য সম্পর্কে সচেতন। ওয়েবসাইটের পণ্যের ছবি শুধুমাত্র উদাহরণের উদ্দেশ্যে এবং তা প্রকৃত পণ্য প্রদর্শিত চিত্র থেকে কিছুটা ভিন্ন হতে পারে। ওয়েবসাইটের এই সকল কার্যক্রম আইন দ্বারা পরিশুদ্ধ ও অনুমোদিত।

৮.২ picky.com.bd-এ কোনো নির্দিষ্ট অ্যাকাউন্টের অধীনে যেকোনো স্বল্প-মেয়াদী বা দীর্ঘমেয়াদী প্রচারমূলক কার্যকলাপ বা অফার(গুলি) ডিফল্টরূপে প্রস্তাবিত সময়ের মধ্যে একটি একক অর্ডারের জন্য বৈধ। যেকোনো অফার বা প্রচারের সময় যে কোনো পুনরাবৃত্তি, সন্দেহজনক বা আপত্তিজনক আচরণের ফলে একটি অর্ডার বাতিল হতে পারে এবং পিকি অন্যান্য ব্যবহারকারীদের অধিকার এবং সুবিধাগুলি রক্ষা করার জন্য এটি করার অধিকার বজায় রাখে। প্ল্যাটফর্মের হাইজিন এলিমেন্ট বজায় রাখার জন্য প্ল্যাটফর্মে যে কোনও অফারকে যে কোনও উপায়ে অপব্যবহার করে এমন অ্যাকাউন্টগুলি বন্ধ করা যেতে পারে। পিকি স্বয়ংক্রিয় অপব্যবহার সনাক্তকরণ সিস্টেম যে কোনও মুহূর্তে এবং কোনও বিজ্ঞপ্তি ছাড়াই ব্যবহার করা যেতে পারে।

৮.৩ বিভিন্ন বিপণন চ্যানেলের মাধ্যমে গ্রাহকদের যেকোন/সমস্ত অংশের জন্য প্রদত্ত ডিসকাউন্ট কোড কর্তৃপক্ষ যে কোনো সময় এবং বিজ্ঞপ্তি ছাড়াই সংকুচিত বা প্রসারিত করতে পারে। কোনো ধরনের অপব্যবহার বা সন্দেহজনক ব্যবহার প্রতিরোধ করার জন্য, মূল্য পরিবর্তন বা ওঠানামা, সেইসাথে ব্যবহারকারী বেস দ্বারা একই ব্যবহারের তীব্রতা মিটমাট করার জন্যও মডেলটি সামঞ্জস্য করা যেতে পারে।

৯। চুক্তি

৯.১। আপনার ফরমায়েসটি আমাদের নিকট পণ্য ক্রয়ের একটি গুরুত্বপূর্ণ অফার। আপনি যখন আমাদের থেকে পণ্য ক্রয়ের একটি ফরমাইশ দেন, তখন আপনি একটি ই-মেইল এবং/অথবা আপনার মোবাইল ফোন নম্বরে আপনার অর্ডারের প্রাপ্তি নিশ্চিত করে এবং/অথবা আপনার অর্ডারের বিশদ বিবরণ সহ একটি ই-মেইল এবং/অথবা SMS পাবেন ("অর্ডার নিশ্চিতকরণ ই-মেইল এবং/অথবা SMS")। অর্ডার কনফার্মেশন ই-মেইল এবং/অথবা এসএমএস হল একটি নিশ্চিত করণ প্রক্রিয়া যে আমরা আপনার অর্ডার পেয়েছি, কিন্তু অর্ডার করা পণ্য(গুলি) কেনার জন্য আপনার প্রস্তাবের স্বীকৃতি নিশ্চিত করে না। তবে আমরা অর্ডার কনফার্মেশন ই-মেইল এবং/অথবা এসএমএস পাঠালে তখন "বিক্রয় করার চুক্তি" নামে একটি চুক্তি পণ্য বিক্রয় আইন, ১৯৩০ এর ধারা ৪(৩) অনুযায়ী সম্পাদিত হয় অর্থাৎ পণ্যের মালিকানা হস্তান্তর নিকট ভবিষ্যতে সংঘটিত হবে যখন পণ্য(গুলি) আপনার নির্ধারিত ঠিকানায় পৌঁছে দেওয়া হবে। আমরা শুধুমাত্র আপনার অফারটি গ্রহণ করি এবং উপরোক্ত "বিক্রয় করার চুক্তি" পণ্য(গুলি) বিক্রয়ের একটি চুক্তিতে পরিণত হয় যেটি পণ্যের বিক্রয় আইন, ১৯৩০-এর ধারা ৪(৪) অনুসারে আপনার দ্বারা আদিষ্ট হয়ে, যখন পণ্য(গুলি) ) আপনার নির্ধারিত ঠিকানায় পৌঁছে দেওয়া হয় এবং সেই সময়ে পণ্যের মালিকানা আমাদের থেকে আপনার কাছে হস্তান্তর করা হয়।

৯.২। পণ্যগুলি আপনার কাছে পৌঁছে দেওয়ার আগে আপনি কোনও মূল্য ছাড়াই আপনার অর্ডার বাতিল করতে পারেন।

৯.৩। মনে রাখবেন পিকি দৈনন্দিন চাহিদা পূরণের একটি নির্ভরযোগ্য মাল্টিভেন্ডার মার্কেটপ্লেস। কাজেই আপনার প্রয়োজনীয় এক বা একাধিক পণ্য এখানে অর্ডার করতে পারেন।

১০। পণ্যের বিবরণ

১০.১। পিকি যথাসম্ভব সুনির্দিষ্ট হওয়ার জন্য সর্বাত্মক প্রচেষ্টা করে। পিকি তার নিজস্ব কোনো পণ্য তৈরি করে না। কাজেই Picky পণ্যের বিবরণ বা অন্যান্য তথ্যের নির্ভুলতা, সম্পূর্ণতা, নির্ভরযোগ্যতা, শুদ্ধতা বা ত্রুটি-মুক্ত প্রকৃতি সম্পর্কে কোনো উপস্থাপনা বা ওয়ারেন্টি দেয় না। যদি পিকি দ্বারা বিক্রি করা একটি পণ্য আপনার প্রত্যাশা পূরণ না করে, তবে আপনার একমাত্র বিকল্প হল এটি অব্যবহৃত অবস্থায় ফিরিয়ে দেওয়া এবং অবিলম্বে আমাদেরকে অবহিত করা।

১১। মূল্য নির্ধারণ

১১.১ অন্যথায় বলা না থাকলে, পিকিতে প্রদর্শিত তালিকা মূল্য বা প্রস্তাবিত মূল্য পণ্যটিতে তালিকাভুক্ত সম্পূর্ণ খুচরা মূল্যের প্রতিনিধিত্ব করে, প্রস্তুতকারক বা সরবরাহকারীর দ্বারা প্রস্তাবিত, বা আদর্শ শিল্প অনুশীলন অনুসারে অনুমান করা হয়; অথবা অন্যত্র প্রস্তাবিত অনুরূপ বৈশিষ্ট্যযুক্ত আইটেমের আনুমানিক খুচরা মূল্য। তালিকা মূল্য, প্রস্তাবিত মূল্য নামেও পরিচিত, একটি তুলনামূলক মূল্য নির্ধারণের অনুমান যা যে কোনো দিনে প্রতিটি স্থানে বর্তমান বাজার মূল্যকে প্রতিফলিত করতে পারে বা নাও করতে পারে।

১১.২। আমাদের সর্বোত্তম প্রচেষ্টা সত্ত্বেও, আমাদের নির্দেশিকায় প্রকাশিত মূল্যে কিছুটা ত্রুটি থাকতে পারে। যদি পিকি দ্বারা বিক্রি করা কোন পণ্যের নির্ধারিত মূল্য আমাদের বিজ্ঞাপনের মূল্যের চেয়ে বেশি হয়, তাহলে আমরা ডেলিভারির আগে নির্দেশাবলীর জন্য আপনার সাথে যোগাযোগ করব বা আপনার ফরমায়েসটি স্থগিত রাখবো এবং আপনাকে বিষয়টি সম্পর্কে অবহিত করব। এছাড়া পণ্যের নির্ধারিত মূল্য যদি পিকির মূল্য থেকে কম হয় তাহলে অতিরিক্ত টাকা আমরা আপনাকে ফেরত দেব অথবা আপনার ইচ্ছা অনুযায়ী আমরা ব্যবস্থা গ্রহণ করব।

১২। নিম্নে বর্ণিত পরিস্থিতিতে পণ্য ফেরত নীতি:

১২.১। ক) ব্যবহারকারী ডেলিভারির সময়, বা পূর্বে উল্লেখিত কিছু হলে ৭ দিনের মধ্যে যেকোন পণ্য ফেরত দিতে পারে। পিকি ক্রমাগত এবং নিবিড়ভাবে পর্যবেক্ষণ করবে এবং এটি প্রতিরোধ করার জন্য প্রয়োজনীয় পদক্ষেপ গ্রহণ করবে।

১২.২।ক) ব্যবহারকারী পণ্য প্রাপ্তির ৭ দিনের মধ্যে মোড়ক না খোলা বা ত্রুটিপূর্ণ আইটেম ফেরত দিতে পারে।

তবে নিম্নলিখিত কারণ সম্বলিত পণ্যগুলি ফেরত বা বদল করা সম্ভবপর হবে না।

১৩.১ গ্রাহকের সন্তুষ্টি অর্জনই আমাদের প্রথম পছন্দ। এই জন্য পিকি তার গ্রাহকদের চাহিদা মেটাতে সদা সচেষ্ট। যাইহোক, আমরা যদি আমাদের প্রতিশ্রুতি পূরণ করতে বা কোনো কারণে পরিসেবা সরবরাহ করতে সমস্যার সম্মুখীন হই, তবে আমরা আপনাকে ২৪ ঘন্টার মধ্যে ফোন, টেক্সট বা ইমেলের মাধ্যমে অবহিত করব। পিকির পক্ষে যদি কোন পরিসেবা সম্পাদন করা সম্ভবপর না হয় এবং অর্থ ফেরত এর প্রয়োজন হলে আপনার অনুমোদনক্রমে অর্থ ফেরতের প্রক্রিয়াটি ৭ দিনের মধ্যে শুরু হবে।

মনে রাখতে হবে যে অর্থ ফেরত প্রক্রিয়াটি দীর্ঘসূত্রিতা হতে পারে এজন্য পিকি অর্থ ফেরত এর পরিবর্তে পণ্যের বদলে পণ্য প্রদানকে বেশি উৎসাহিত করে।

উপরে বর্ণিত তিনটি ক্ষেত্রেই ফেরতের পরিমাণ গ্রাহকের পিকি ব্যালেন্সে জমা হবে এবং অবশিষ্ট ব্যালেন্স শুধুমাত্র পিকিতে কেনাকাটায় ব্যবহার করা যেতে পারে। ফেরতের অর্থ গ্রাহককে নগদ বা মোবাইল ব্যাঙ্কিং ব্যবহার করে প্রদান করা হবে। গ্রাহকের অনুরোধ পাওয়ার ৭ দিনের মধ্যে বিকাশ, কার্ড বা অন্যান্য ইলেকট্রনিক পদ্ধতিতে অর্থ ফেরত প্রদান করা হবে। অবশ্য যারা নগদ অর্থে পণ্য ক্রয় করেছেন তারা তাদের অর্থ শুধুমাত্র পিকির অন্যান্য পণ্য ক্রয়ের জন্য ব্যবহার করতে পারবেন।

১৪। সরবরাহ নীতি:

১৪.১ পিকি পণ্যের মান নিয়ন্ত্রণ বজায় রাখার চেষ্টা করে কিন্তু মানের নিশ্চয়তা দেয় না কারণ পিকি

কোনও পণ্য ডিজাইন বা তৈরি করে না। আমরা বিশ্বাস করি যে প্রস্তুতকারক, বিক্রেতা বা সরবরাহকারী পণ্যের গুণমান নিশ্চিত করতে সম্পূর্ণরূপে সক্ষম।

১৪.২ যদি কোনো ব্যবহারকারী তাদের অর্ডারকৃত পণ্য পাওয়ার পর তাদের স্বাস্থ্য, জীবন বা নিরাপত্তার জন্য ক্ষতিকর কোন পণ্য বলে বিবেচিত হয়, তাহলে আমরা সম্পূর্ণ দায় ভার গ্রহন করব এবং সেই পণ্যের ফেরত গ্রহণ করব। কোন ডেলিভারির ১২ ঘন্টা পরে যদি সেটি ব্যবহারকারীর জন্য হুমকি স্বরূপ বলে মনে হয় তাহলে সেটিকে আমরা প্রস্তুতকারক এবং সরবরাহকারীদের গুণগত মানের নিশ্চয়তার একটি ত্রুটি বলে বিবেচনা করব।

১৪.৩। ওয়েবসাইটে প্রদর্শিত সকল পণ্য পরিবর্তন ও পর্যাপ্ততা সাপেক্ষ।

১৫। সংশোধন ও যোজন বিয়োজন

১৫.১। পিকি এই সকল শর্তাবলীর সংশোধন পরিবর্তন ও পরিমার্জনের অধিকার সংরক্ষণ করে। picky.com.bd এ পোস্ট করার সাথে সাথে এই ধরনের পরিবর্তন কার্যকর হবে। আপনি এই ধরনের পরিবর্তনকে পর্যালোচনা করতে পারেন। আপনার অব্যাহত অ্যাক্সেস বা picky.com.bd-এর ব্যবহার পরিবর্তিত শর্তাবলীতে আপনার সম্মতি বলে বিবেচিত হবে।

১৬। পিকির সফ্টওয়্যার শর্তাবলী

১৬.১ পিকি সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার: আপনি পিকির সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করতে পারেন শুধুমাত্র পিকি দ্বারা প্রদত্ত পরিসেবাগুলি ব্যবহার এবং উপভোগ করার জন্য যা এই শর্তাবলী দ্বারা অনুমোদিত৷ আপনি আপনার নিজস্ব প্রোগ্রামগুলিতে পিকি সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপের কোনও অংশ অন্তর্ভুক্ত করতে পারবেন না বা আপনার নিজের প্রোগ্রামগুলির সাথে এটির কোনও অংশ সংকলন করতে পারবেন না, অন্য পরিসেবার সাথে ব্যবহারের জন্য এটি স্থানান্তর করতে পারবেন না, বা বিক্রি, ভাড়া, লিজ, ধার, ঋণ, পিকি সফটওয়্যার/অ্যাপ্লিকেশন/অ্যাপ বিতরণ বা উপ-লাইসেন্স বা অন্যথায় পিকি সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপকে সম্পূর্ণ বা আংশিকভাবে কাউকে দেয়া যাবে না। আপনি পিকি সফটওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করতে পারবেন না কোনো বেআইনি উদ্দেশ্যে। আমরা যেকোন পিকি সফটওয়্যার/অ্যাপ্লিকেশন/অ্যাপ প্রদান বন্ধ করে দিতে পারি এবং আমরা যেকোন সময় যেকোন পিকি সফটওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করার আপনার অধিকার বাতিল করতে পারি। পিকি সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করার জন্য আপনার অধিকারগুলি স্বয়ংক্রিয়ভাবে আমাদের কাছ থেকে বিজ্ঞপ্তি ছাড়াই শেষ হয়ে যাবে যদি আপনি এই শর্তাবলীর যেকোনো একটি মেনে চলতে ব্যর্থ হন। যেকোন পিকি পরিসেবায় ব্যবহৃত সমস্ত সফ্টওয়্যার হল পিকি এবং/অথবা এর সহযোগী বা এর সফ্টওয়্যার সরবরাহকারীদের সম্পত্তি এবং বাংলাদেশের আইন দ্বারা সুরক্ষিত কিন্তু কপিরাইট আইনের মধ্যে সীমাবদ্ধ নয়।

১৬.২। আপনি পিকির সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহারকালীন হয়ত এক বা একাধিক তৃতীয় পক্ষের পরিসেবাও ব্যবহার করতে পারেন, যেমন একটি বেতার ক্যারিয়ার বা একটি মোবাইল প্ল্যাটফর্ম প্রদানকারী৷ এই তৃতীয় পক্ষের পরিসেবাগুলির নিজস্ব নীতি, পরিসেবার শর্তাবলী এবং ফি থাকতে পারে যা আপনার ব্যবহারের জন্য প্রযোজ্য।

১৬.৪। আপডেট: আমরা পিকি সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপকে আপ-টু-ডেট রাখার জন্য যে কোনো সময় এবং কোন বিজ্ঞপ্তি ছাড়াই স্বয়ংক্রিয় বা ম্যানুয়াল আপডেট দিতে পারি।
